Essential Reef

Effective upon publication

ESSENTIAL REEF & CO. LLC respects the intellectual property rights of others and expects users of the Essential Reef app to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement.


1. Reporting Copyright Infringement

If you believe content on Essential Reef infringes your copyright, you may submit a DMCA takedown notice.

Required Information

Under 17 U.S.C. § 512(c)(3), a valid DMCA notice must include ALL of the following:

  1. Identification of the copyrighted work claimed to have been infringed (e.g., title, description, URL to original)
  2. Identification of the infringing content on Essential Reef (specific location — screen name + content description is sufficient; URLs if available)
  3. Your contact information: name, address, phone number, email
  4. A statement under penalty of perjury that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
  6. Your physical or electronic signature

Incomplete notices will not be processed.


2. What Happens When We Receive a Valid Notice

  • We review the notice within 5 business days
  • If the notice is valid, we remove or disable access to the infringing content
  • We notify the user who posted the content and provide them with the notice (redacted of your address/phone if you request)
  • The user may submit a counter-notice (see below)
  • Repeat infringers have their accounts suspended or terminated

3. Counter-Notices

If your content was removed and you believe the removal was based on a mistake or misidentification, you may submit a counter-notice.

How to Submit a Counter-Notice

Required Information

A valid counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and the location (URL or description) where it appeared
  3. A statement under penalty of perjury that you have a good-faith belief that the content was removed by mistake or misidentification
  4. Your name, address, phone number, and email
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Southern District of Florida if you are outside the US)
  6. A statement that you will accept service of process from the person who submitted the original DMCA notice or their agent

What Happens Next

  • We forward your counter-notice to the original complainant
  • If the complainant does not file suit within 10-14 business days, we may restore the content
  • Filing a false counter-notice is perjury; do not submit one if you are not the rightful owner

4. Repeat Infringer Policy

Accounts that receive multiple valid DMCA notices will be:

  • Warned after the first valid notice
  • Temporarily suspended after the second valid notice
  • Permanently terminated after the third valid notice

We reserve the right to terminate repeat infringers at our discretion, regardless of count.


5. False Claims

Knowingly materially misrepresenting that content is infringing (or that removal was a mistake) can result in liability for damages, including costs and attorneys' fees.

Do not submit a DMCA notice for:

  • Content you do not own (even if you would prefer it be removed)
  • Fair use cases that are clearly non-infringing
  • Content simply because you disagree with it (use the standard report feature for Community Guidelines violations instead)

WYSIWYG stands for "What You See Is What You Get." If a coral is labeled that way, the exact piece in the photo is the one you'll receive.
